$12M Lawsuit: Tortured Caledonia Couple sues Government – OPP

CaledoniaWakeUpCall and VoiceofCanada have obtained a copy of the Statement of Claim for a $12,000,000 lawsuit against Gwen Boniface, Julian Fantino, Brian Haggith and the Province of Ontario by Caledonia residents Dave Brown and Dana Chatwell. 

The suit itself is not only against the Government and OPP force, it’s filed against the Province of Ontario, OPP Commissioner Gwen Boniface who was in charge when the criminal occupation of DCE began, OPP commissioner Julian Fantino, and OPP inspector Brian Haggith who was in charge in Caledonia at the time.

The $12 Million is arrived at as follows: $5,000,000 against Gwen Boniface, Julian Fantino, and Brian Haggath for misfeasance in a public office, negligence, false imprisonment, assault, trespass, illegal surveillance, and breach of the plaintiffs rights under the Canadian Charter of Rights and Freedoms. 

$5,000,000 against the crown for private nuisance, misfeasance in a public office of her servants and agents, and in vicarious liability for the conduct and torts committed by Gwen Boniface, Julian Fantino, and Brian Haggith, and the Crowns agents, servants and/or employees.

$2,000,000 for aggravated and punitive damages. 

We have all heard about many of the terrorist activities that took place in full view of OPP officers who refused to come to the aid of innocent victims, so I’ll focus on a few incidents cited in the lawsuit that are not as well known to the public.

 In the summer of 2006, Two OPP officers who inadvertently drove onto the Sixth Line Road were surrounded by “protestors” and held hostage for several hours while the OPP refused to come to their assistance.

At approximately 1am on May 8 2006, David Brown was returning to his home after attending a baseball game in Toronto. Native protestors denied him access to his home from their illegal blockade and when he continued to drive home, 15-20 of them followed him, attacked him and dragged him to a Police line where the OPP obeyed the demands of the Native Protestors to illegally imprison Mr. Brown on the unfounded grounds that he had assaulted them, was trespassing (on his own property) and “breached the peace”. 

When Dana Chatwell witnessed Mr. Brown being attacked on their property by the Native Protestors she called 911 and the operator refused to send anyone.

The next day Mr. Brown was released from his illegal confinement and the OPP refused to escort him onto his property inside the illegal barricades.

The OPP refused to warn Brown and Chatwell of their impending failed raid of DCE on April 20 2006, despite their close proximity to the property, and a specific request to do so in order for Brown and Chatwell to take appropriate measures to ensure their safety.

After their home was ransacked and vandalized by these criminals, the OPP offered to install surveillance cameras hidden inside of outdoor lights around their home. David Brown agreed on the grounds that these cameras would only be installed outside of the house. The OPP were provided with a key to their home while they were on vacation, and illegally installed video surveillance equipment in one of their kitchen cabinets focused on their kitchen table.

On many occasions as outlined in the lawsuit, the OPP have stood by and observed but refused to act as Native protestors threatened them with bodily harm, threatened to burn their house down, threatened to take over their property, illegally searched and stole items from their vehicle, shining headlights and spotlights into their home throughout the night, trespassed onto their property, and the uttering of loud noises from screaming and chanting to loud unusual vocal noises throughout the day and night.

These people have clearly been left to be terrorized at will by the Natives of DCE by the OPP who have completely abandoned the rule of law in Caledonia at the whim of a small group of thugs.To add insult to injury, the OPP placed hidden illegal surveillance in their kitchen.

Congratulations to Dave Brown and Dana Chatwell for taking the initiative and showing the courage to fight back against the many people who have conspired to ensure their torment at the hands of Native Criminals.

    Jeff: these people have suffered directly the loss of their security and freedoms as Canadian citizens…they have been deprived of these so that politicians and bureaucrats can be insulated from the fallout of their dystopian social policies.

    I am heartened to see these people seek justice. I am heartened to see that they intend to extract justice from the politicians responsible and that “malfeasance” is in the law suit. It certainly is a case of malfeasance…Bryant, NcGuinty and Fantino being the greatest offenders. Hopefully if this suit goes ahead and we can get the courts to agree that malfeasance was present, then a mass criminal compalint can be launched against the offenders.

    More vile in nature than the SN terrorists and extortionists in this trilogy are the duplicitous politicians who have surrendered the rule of law to the lawlessness of SN trespass.

    These politicians are about as criminally responsible as the renegades they placate…it is not good enough to simply hurl them from office…they must be prosecuted as a warming to futire slime balls who would use public office in a manner contemptuous of the constitution, rule of law and the welfare of the people.

    Well I am certainly glad someone has the balls to stand up to these spineless and gutless politicians and OPP,BUT if you really think the corruption in the Liberal party and OPP ends with them you are sadly mistaken. The corruption Starts with the supreme courts and trickles down all the way to our traffic courts. All one has to do is read the papers where another police officer is found Not Guilty for beating a person who they say was resisting arrest, or he looks all bruised and battered because he fell down some steps while trying to escape. Or a politician caught with his hand in the cookie jar or dolling out favours to friends , they almost ALWAYS get off and we damn well know their guilty. As far as Brown and Chatwell,s lawsuit goes I truly wish them all the luck in the world, but some crooked judge pressured by the Government will find some way or excuse to dismiss their case. That,s how I feel about our justice system now, we don,t have one.
