OPP used McHale as guinea pig for failed experiment

A report coming soon to www.caledoniawakeupcall.com from the OCCPS investigation into the arrest and imprisonment of Gary McHale on December 16, 2006 has determined (big surprise) that the officer who violated Mr. McHale’s rights was not in violation of the OPP standards of professional conduct. It also reveals that the OPP went to great expense to use Gary McHale as a guinea pig for experimenting in how far they can push the limits of “breach of the peace”.

Interviews with 14 police officers involved reveal that high level meetings were held prior to December 16 to determine what course of action the OPP could take in suppressing our right to hang a flag on a hydro pole, and to what extent the charge of “Breach of the Peace” could be used against not only Mr. McHale but residents of Caledonia as well.

McHale was singled out as the leader of a peaceful group who were protesting the arrest of a Caledonia resident who had tried to hang a flag on a pole as is his legal right, but the decision to detain him overnight without a charge was made to attempt to have a peace bond placed on him the following morning to keep him out of Haldimand County.

There was no legal precedent for this at the time and officers spent the entire day and night in contact with lawyers and crown attorneys trying to find something obscure in the criminal code which would allow them to ban a civil rights activist from the County.

Officers were assigned to put together the necessary documentation while McHale sat in a jail cell overnight for standing in a field, and their attempts to place a ban on him for doing nothing were an abysmal failure as the crown refused on the grounds that there was no legal means to do so. The documentation they came up with by the time Mr. McHale appeared in court was quite literally nothing. Not one shred of evidence was presented.

Officers freely admit that Mr. McHale was passive and cooperative while incarcerated and that they were aware of his message of peaceful, non violent protest yet they use the excuse that he had to be held overnight to prevent a breach of the peace from occurring as they were afraid the remaining crowd of zero people on Argyle Street would be incited by McHale if he were released later that afternoon.

The true reason for the trumped up charge of “interfering with the duties of a police officer” is that the OPP have no authority to have someone barred from DCE, Caledonia, or Haldimand County for the offence of Breach of the Peace, so they will instead misuse the criminal charge of interfering with the duties of a police officer if given the chance.

The 38 page document which concludes that they can’t prove it was legal to hold Gary overnight is a fascinating read that reveals the true reason for the arrest and detention overnight was to test a new way of controlling the residents of Caledonia while ignoring the criminals at DCE. A plan the OPP were proud of until they found out it had as much chance of success as an OPP raid on illegally occupied land.

    Well Gary is in good company as a guinea pig….the OPP have used the non native residents of Caledonia and Ipperwash as guinea pigs for years now. I guess the purpose of the experiment is to see how badly they can distort the equal application of the rule of law before the citizens take the policing francise back from them with a vice regal decree…..or they all move out of town… what ever comes first.

    I feel so sorry for you and your puppet master. You two really don’t understand that people are laughing at you. Gary has lost so much credibility that he is honestly a joke. I live in Brantford and we are just thankful he hasn’t chosen this city to run his self serving agenda. He is obviously a control freak and I don’t mean to be mean or rude but the only way that some friends and I can come up with on how you and his other little buddy are so controlled by him is you clearly have to be in love with him. It’ s a shame because controlling relationships are not good and there are plenty of support group that can help you get over him and find someone that would treat you right and not try to control you. Hope you get out of the shadows of gary and into a relationship that is healthy for you.

    You say that I don’t understand, so please allow me to explain some things that I certainly do understand to you.

    Gary, Mark and myself don’t need to matter to or (no offence) impress you in order to be doing our jobs properly. Those who live in the “hot zone” in Caledonia and who are impacted each day by the ongoing lawlessness have made it clear to us that we represent, and provide a much valued service to them.

    You and a few others keep saying we’re not wanted in Brantford, but when we visited in September we received more thumbs ups, honking, waving, and hollering of support then I could keep track of and all of 2 people drove by to flip us off. Not quite the majority that has been suggested.

    If you see a group of people who have given up their day to day lives and dedicated themselves to defending the basic rights of fellow Canadians as “self serving” then we will simply have to agree to disagree.

    I certainly appreciate the free relationship advice, but (shockingly no doubt) I am not in love nor in that sort of relationship with Gary McHale, and it is quite possible to have a friend and co worker that you don’t hate without being in love with them. I don’t generally speak for Gary or Mark but in this case I’ll make an exception as I can assure you that they are not in love either. Where do the wives fit into your vision?

    You are certainly welcome to laugh heartily at anything or anyone you wish to, but if you honestly see humor in a situation where children are unable to feel safe in their homes, and everyone is subject to the removal of their basic civil rights at the whim of a few criminals, you may wish to seek some sort of help.

I wonder how Katy would feel if the DCE thugs took her house, raped her sister, beat her father almost to death and kept her sister’s children afraid in their homes because they ordered the OPP not to patrol their street? In that case, I imagine she’d be complaining how nobody stood up to help her.

    The irony is, Katy, despite your insults, Gary, Jeff and I would still risk everything we have to stand up for you and your family.
