Bill C-21 helps dispel “sovereign nation” notion

After 30 years of dragging their feet, the Canadian government has finally passed legislation that gives Natives the protection of the Human Rights Act. This is great news not only because it grants basic human rights to people in need, but because it also helps establish that Natives are as Canadian as you or I.

When the Canadian Human Rights Act was passed in 1978, it excluded Natives who were considered to be governed by the Indian Act. One has to wonder how long such a policy would have lasted if Canada had told black people “You don’t have human rights because you are governed by the Negro act.”

Bill C-21 is a good first step toward solving the much bigger problem of treating Native people as though they are different from the rest of the country, and it helps to begin clearing up any misunderstanding that some may have about Natives being a “sovereign nation”.

The belief held and spewed by the tiny group of extremists who are being allowed to cause so much trouble is that they are a country living within a country and not subject to any laws they choose to break. They claim that “turtle island” (North America) belongs to them because their ancestors were here before ours were, and all of us pesky Canadians are actually just “squatters” on their land.

Being born here doesn’t make you any less of a “squatter” because you’re simply a descendant of a conqueror in their eyes. Personally I prefer to think of myself as “Canadian”.

Of course the biggest problem with the sovereignty argument is that they exist purely on resources given to them by Canada and nothing about them is even mildly independent. We hand a small group of people some $15 Billion each year for which there is absolutely no accountability. This leaves corrupt leaders free to line their pockets while we continue to hear stories about reserves that lack drinking water.

Any attempt to debate such points with the extremists immediately leads to accusations of racism and a tirade about how you are a Genocidal European Colonizer. Truly the equivalent of putting their hands over their ears and screaming “lalalalala” to drown you out.

Congratulations are in order to Canada for finally establishing that Natives are entitled to the same rights as the rest of us, but we need an equally strong federal statement to remind the Fantino’s and McGuinty’s of the world that equal rights does not mean extra rights.

    How can you be “sovereign” when you also claim to be a ward of the state? Well I suppose it’s possiblew if you use the new FN pretzel logic and revisionism.

    This issue was settled years ago. It’s annoying to see so may short memories to allowi it to spring up again without a decisive Federal rebuke.

    Confederacy says it bases its sovereign nation status on the Nanfan Treaty of 1701.

    When that treaty was signed, no member of what is now Six Nations lived anywhere in what is now Southern Ontario let alone the Grand River Valley.

    The Six Nations also did not occupy any lands in this area at the time that the British declared sovereignty over what is now Ontario with King George’s Proclamation of 1763

    Second, we have the treaty itself where the British (Nanfan was the Governor of New York at the time) agreed to protect what is now Six Nations in their hunting grounds but in return what is now Six Nations, to paraphrase the treaty, did surrender, deliver up, and forever quit claim, for themselves and their heirs, all right, title and interest to those lands to the British Crown and that the Five Nations, now Six Nations, were subjects of the Crown so there is no question of any Native “sovereignty” in the area the treaty covered.

    Then in the text from the Ontario Court of Appeal decision that is most interesting and needs to be repeated… from Isaac v. Davey Ontario Court of Appeal, Schroeder, Jessup and Arnup JJ.A., 4 October 1974 we finds this:

    “In May, 1784, Haldimand on behalf of the Crown purchased from the Mississagas a large tract roughly described as six miles deep on either side of the Grand River from Lake Erie to the head of the river. On October 25, 1784, he issued the ‘Haldimand Proclamation.’

    “Brant interpreted the Haldimand Proclamation as having two effects:

    “(i) as being full national recognition of the Six Nations as an independent national community;

    “(ii) as a grant of the Grand River lands to the Six Nations in fee simple.

    “The British Government firmly resisted both propositions, and the Crown’s position has never changed. At least some members of the Six Nations have perpetuated Brant’s position. (The allegation of national sovereignty was made in this very action but abandoned at trial.)”

    SN sovereignty and claims case closed.

    Perhaps it’s time the feds reinforced this position with force of law and an injuction for SN to cease all actions taken under such premises.

    Wondefully written but you will most likely receive a lot of hate mail. The truth always hurts. A person no matter race or color has to want to change and work towards that goal in order to better oneself. But, the warriors are more interested in creating chaos than working to better the life of their children. What will they do with either a pay off in the shape of money or land? We came, we conquered and that is history……..

    You raise a very good question. What would the extremists do if the claims were settled and their excuse for attacking us vanished? My personal opinion is that a new group of Natives with a new claim would suddenly appear to ensure that this never ends.

    They thrive on the chaos that our government and the OPP allow them to create in the name of land claims, but what good have they done for their communities in the process? None.

    As for us coming and conquering, they like to say that this land was given to them by the creator which is fine, but if that’s true then he obviously later decided to give it to us. Does that make god a racist?

    Indeed sir, but a great example of where the true racism and hatred is coming from in all of this. That comment truly embodies the attitude I’ve seen from the majority of the Natives involved in the Caledonia crisis over the last 2 years.

    Maybe “warrior” could answer a few questions as he is such an authority on the issues at hand.

    Are the tire fires used to intimidate the OPP and Caledonia residents a form of protecting the environment?

    Do the DCE thugs drive Chevy Avalanche’s and Cadillac Escalades that get 10mpg in order to help control pollution?

    If the creator doesn’t want “us” here, why did he put us here?
