2009 was a landmark year for CANACE to say the least. We have perhaps appeared relatively quiet to the general public as of late because the bulk of our work has been in the Ontario court system, but this should not be confused with a lack of action on our part as we’ve been furiously busy.

On January 12 we won a precedent setting legal ruling which began to reshape the way that prosecution by private citizens is handled by the courts and the crown. See the ruling here, and the Parkinson v R page for more details. This followed an equally important December 2008 Parkinson v. R ruling.

January 27 CANACE founders traveled south of the border to meet with US officials and provide them with evidence regarding attacks on ATF agents and border patrol guards in Caledonia. Being invited into another Country to provide evidence that our own government refused to hand over to the States was to say the least one of those days that you realize you’ve accomplished something.

UPDATE January 8 2010: A justice of the peace has officially signed the charge against Julian Fantino this afternoon and he will be summoned to Cayuga Court to face the criminal charge of influencing a municipal official which carries a maximum of 5 years in prison.

Remember when Michael Bryant killed a man in 2008 how the media and public were quite convinced that as the former Attorney General he would receive preferential treatment and would not be able to receive a trial that was in the best interest of justice?

Although Julian Fantino has never held any office with the prestige of Attorney General, he is every bit the public figure that Bryant was, and the same concerns should be on the minds of all of us now that he stands charged. Add to that the fact that our government has already taken numerous steps to cover up for Fantino and it’s very difficult to believe that the crown will be capable of treating Mr. Fantino in a way that’s in the best interest of the public.

Steps could certainly be taken to ensure that justice prevails in this case, but there would need to exist a will within the Ontario government to stop covering for their appointed enforcer of race based policing. They could simply stop interfering with the justice system, but that seems somewhat doubtful at this point. There is a very simple solution that not only ensures Fantino won’t receive special treatment, but takes that decision out of the hands of the McGuinty government in the eyes of the public.

Thanks to the tireless efforts of CANACE and Gary McHale who has been pursuing this particular case relentlessly for 2 years, OPP Commissioner Julian Fantino is now facing the criminal charge of Attempting to influence a municipal official.

Much will be written about the technical details of the Order of Mandamus that Gary McHale won in Cayuga Court today, but having had the pleasure of being there to witness history and having won my own in January of 2009, I want to share some of the implications of what our rulings mean when put together.

Each made legal history and quite literally created case law that Canadians will be using in court forever, but they also have a very direct impact on the way the corrupted crown operates when dealing with private prosecution and CANACE right now. They have been attempting to obstruct our path to resolving the lawlessness in Haldimand County for years, but their ability to do so is beginning to deteriorate in the face of something they had perhaps forgotten about: The law.  We have long held that the tactics of the crown would not be able to hold up to scrutiny by a Judge and have proven it with 3 precedent setting rulings in the past 7 months.

For the second time in two years, the Ontario Provincial Police set up the members of CANACE to be physically attacked by a group of Natives who far outnumbered us. This time it was Mohawks in Deseronto instead of Six Nations thugs in Caledonia, but the intended outcome was unquestionably the same.

The last time this happened was December 01 2007 and the result was Gary McHale and I being taken away by ambulance after a protest over an illegal smoke shack in Caledonia. This time was a more elaborate setup but the outcome was certainly intended to be violent. Fortunately for everyone but the OPP, this time it didn’t work.

During the testimony that Julian Fantino gave a Hamilton Court last month about his involvement in the witch hunt to charge Gary McHale with “Counselling mischief not committed”, Julian was forced to reveal on the stand that he sent an email on December 3, 2007 to deputy commission Chris Lewis in which he stated “I feel like doing what LA Police Chief Darrel Gates go out and arrest the goof myself”.

Just who is this Darrel Gates that Julian idolizes? McHale’s efforts to clarify were quickly interrupted by Mitch Hoffman in order to prevent Fantino from being held accountable for his words. So since we’re not allowed to hear it from the horse’s mouth, I decided to have a look for myself (and all of you) at who Gates is and why Julian so admires him and it quickly became obvious that there are similarities.

One of two things happened in a Hamilton court room this week. Either Julian Fantino lied through his teeth under oath, or he proved that he has the worst memory of anyone I have ever known.

When pressed for details of his extensive involvement in targeting Gary McHale for arrest despite “legal nuances” such as his innocence, Fantino repeatedly answered “I don’t recall”.

A clearly hostile Fantino did however seem to remember Caledonia residents protesting at his home although he couldn’t seem to manage to talk about even that without tossing in some totally false information such as people yelling things as his wife and children.

Having attended the mammoth trial of epic proportions this week to testify, I had the interesting fortune of appearing immediately before Julian Fantino. As I have not yet finished giving evidence, I was not able to sit in on the rest of the day’s proceedings, but I did have my first face to face encounter with Julian Fantino in the hall on my way out.

The first thing to become evident from looking at Julian was that he has absolutely no regard for anyone’s hard earned tax dollars and appears to live in a bubble world of his own from which he tries to dictate to the rest of us.

First there was the special reserved secure underground parking that was reportedly provided for him as the streets of Hamilton are not good enough for Mr. Fantino to park or walk on. Then there was the elevator that was locked down for his use. Maybe the man feels compelled to press all of the buttons at the same time and they had to lock up an elevator so that it could be remotely directed to its destination?

The McHale trial for “counselling mischief not committed” ground to a halt today due to one of those legal nuances that Fantino hates being bogged down by. It seems that since those responsible for this bogus charge were acting under Julian’s orders to ignore the fact that Gary didn’t actually do anything wrong, nobody realized until today that if found guilty of making a suggestion not taken, Gary could spend 5 years in jail.

Throughout the proceedings that have taken place over the last year, many people in the judicial system have stated that they had never heard of counselling mischief not committed, and the crown has stated from the beginning that they (as ordered by Fantino) were only seeking travel restrictions on McHale even if he were to be found guilty at trial.

Mark November 20, 2008 on your calendar ladies and gentlemen as today is a day that your children and their children’s children will be learning about in history classes for generations to come.

In fact it’s such a monumental event of gargantuan, humungous, mind blowing, future altering, awe inspiring, unthinkably behemoth proportions that I feel before we can even discuss what’s going to happen this day, we must first observe the history of November 20 of years gone by before they’re dwarfed by what is to come.

On November 20, 1194 Palermo is conquered by the Holy Roman Emperor Henry VI. 1789 New Jersey becomes the first State to ratify the Bill of Rights (how fitting), 1910 the Mexican Revolution begins, 1945 Trials against 24 Nazi war criminals begin at Nuremburg, 1962 the Cuban missile crisis ends, and in 2008 the trial of the century is about to begin.

Today the trial that will settle what some may call the most serious charge in Canadian history will commence. Today Gary McHale goes on trial for Counselling mischief not committed.

“I don’t want us to get bogged down with legal nuances” (the law) said Julian Fantino in an email to investigating officers on December 2 2007, “surely experienced investigators don’t have to go running to a Crown to know when they have RPG to arrest/charge someone!”

Perhaps someone needs to point out to the “top cop” in Ontario that legal Nuances are the only thing standing between us and a Police State.

After being abandoned by their police force and government in 2006, Caledonia residents awoke today to learn that their neighbours in Simcoe voted to damn them to 4 more years of suffering with an MP who is perhaps the most useless and apathetic in the history of our Country.

Thousands of people dared to believe that their voice could make a difference by voting for Gary McHale, but Simcoe which has not yet suffered at the hands of Native terrorists and a crippled OPP voted to hand the status quo another term and a gold plated pension.

Lest there be any doubt that Diane Finley is a desperate woman whose campaign has gone up in flames, we have confirmation today that she is skipping yet another debate (this time shunning the Rotory club in Simcoe) to spend the day travelling around Caledonia with the minister of finance Jim Flaherty.

Hopefully someone will think to ask him about the $0 he has given to the businesses and residents of Caledonia and the millions given to the OPP to nap in their cars for the past 2 ½ years.

Just in case sauntering around with Flaherty isn’t enough to blind voters to the fact that she abandoned them as soon as the going got tough, a plane carrying Prime Minister Stephen Harper is scheduled to land at Mount Hope airport tomorrow.

Perhaps while Harper is trying to schmooze with the little people in this riding, someone can ask him where he’s been while the residents of Caledonia have been under attack.
